It seems that yelling "I hate white people" and then punching one is not a hate crime in Canada. This judge just set a dangerous prescience that will haunt Canadians for generations, I sure hope you have an appeals process.

“The offender said, ‘I hate white people’ and threw a punch,” Van Harten told those gathered in the court during his ruling. “There is no evidence either way about what the offender meant or whether . . . she holds or promotes an ideology which would explain why this assault was aimed at this victim. I am not satisfied beyond a reasonable doubt that this offense was, even in part, motivated by racial bias.”

The Calgary Herald reported that the attack happened suddenly and without warning.

White was standing outside the pub talking to another person when Crowchief walked up and yelled “I hate white people” before punching White in the face, the paper reported. After the assault, Crowchief left the scene, but White followed her and called police.

When authorities arrived and arrested Crowchief, she told them “the white man was out to get her,” the paper reported.


I don't think this is right. If you yell "I hate <insert color> people" then punch them its a hate crime but if you use white then its not a hate crime. If you do this against a black man its almost automatically considered a hate crime. Do you think this it is right to be promoting double standards based on if you are a certain color?

Van Harten agreed with Iovinelli the more than six months Crowchief had spent behind bars, which he equated to a 9 1/2-month sentence, was sufficient jail time for Crowchief.

since being white has become part of a new civil rights movement, it's not going to be considered a hate crime and people are probably going to get away with it. currently, in the states, we got the knock out game and antifa, both leading the front when it comes to white violence. well that and the "warriors" of course. somewhere it's gotten into their head (thanks obama/some left) that it's bad to be white and you should hate on them. that all other races are okay, but white race is bad. I dunno I sort of feel bad for the whites (albino) I'd be totally upset if I couldn't go outside due to a skin condition

Canadians on this website call him out for not reading the stuff he posts. This is typically a topic where he pushes some extremist narrative. He then gets mad and says they have no place in a conversation about how America works.

of course not in Canada and in Europe and soon I am sure in the US hate crimes against white people are impossible.

I'm not asking for more time behind bars, I'm asking for the person to be charged with a hate crime which you would argue would come with some mandatory minimal sentencing but there's only maximum sentences not minimal sentences for hate crimes. I'm not even a fan of the whole "hate crime" charge.

Based on what the article is saying, they couldn't establish that the crime was hate motivated. When someone is already angry and already drunk, them yelling "I hate white people" before punching someone doesn't make that the primary motive nor does it make it a hate crime. They were already intending to commit the crime because they were angry and drunk.

These hate crime laws were never intended for momentary lapses of judgement caused by alcohol. Hate crimes are literally caused by someone's prejudice and the motive is an attack on a victim because of their prejudices. This is easily the right call and there is almost no question about it.

Now, had they been able to establish that the defendant intended to attack the victim because they were white prior to becoming angry or drunk, then that would be a different story. Maybe the defendant actually does hate white people? Sure. But it doesn't come into play when the motive is established to be something other than hate.

The devil is probably in the details, which that article is sparse on. Like LakeJucas explained, it's largely dependent on whether the police find reason to believe the attacker intended to attack people out of prejudice regardless of their drunkenness or lack thereof. If they have reason to believe so, it will be considered a hate crime. If not, it's not.
