I'm pretty sure hate crimes are already legally recognized as different from normal crimes, and treated more severely (at least in the States).

its probably not even a hate crime

for example

lets say some kid calls a guy stupid. The other kid says you are doing a hate crime because I am black.

Thats like fake racism.

now this would be a hate crime in south parks defination if you watch south park. Or do you mean if someone killed another person depending on their race then thats totally different.

hate crimes are too fuzzy a term, i dont think the specific should have anything to do with classifying the crime unless its a question of absolute fact eg. 1st degree murder vs 2nd degree

the law is fine the way it is, people get punished, for there crimes and they serve it. plus i don't think any one would go threw so much trouble just to change it, believe me it;s a lot of things you have to do just to change even the smallest of laws.

Some states do have criminal enhancements for hate crimes. Just as they do for gang violence. For example, a man is shot in the street by another man. Both are gang members of rival gangs. The shooting that would normally have resulted in assault with great bodily injury has now been inhanced to include street terror (gang violence) and carries a heavier penalty, usually more jail time or if this is not the first offence, an extended prison sentence. The same goes for violence against someone that is motivated by hate. That is more difficult to prove and the prosicutor would need to have evidence to support the claim itself. Just because two people of different color or sexual orrientation get into a fight, it doesn't mean it is motivated by hate. However, if there is a history of fviolence or prejudice by the attacking party then the D.A. could put forth into the charges the special allegation of a hate crime.

I'm sorry you don't know any good ones. I know many who are very good at their jobs and very fair. I also have known a couple who were not and was happy to see them dissmissed from their position. Officers are held to higher standards for a reason, If they are to police us, then they should uphold the law themselves and be true and honest agents of the law. Unfortunatly, corruption is everywhere. We live in a world were teachers are arrested for having sexual relations with our children and priests are arrested for the same thing. It is all very disturbing.

I think things like beatings, denying business, and things like burning crosses in yards should be more severe, but if you call some one a racist name and are serious your just stupid!

Increasing punishment crimes in today's world has been a blatant hypocrisy. If a white man hits a white man, it's a crime, but when a white man hits a black man, it's a hate crime. Instead of treating people of other races equally, they treat them differently, thus making another distinction between races.

Watch the first episode of the fourth season of Southpark and then you'll know what I mean. http://www.southparkzone.com/episodes/401/Cartmans-Silly-Hate-Crime.html

Hate crimes are so incredibly hard to call that I would hesitate to even accuse someone of one. False accusations of hate crimes are very problematic, because what ends up happening is that racial tension is increased. Increasing severity of the punishments for hate crimes would likely increase racial tension as well. I don't think any punishment will cure racism. Only time and slow cultural change will do that (though you could argue that a nihilist method could work, I disagree). Honestly, increased punishment for cross-racial crimes is already a little biased. A violent crime between a white and a black should probably recieve the same punishment as any other crime. Similarly, slander and other verbal crimes should also be punished the same way regardless of the race of the involved parties.

Basically, see arx7arbalest's post. It says it all.
