No fallacy is committed simply by concluding that incest is fine based on the right to consensual sex in the home. Just because two people are of the same family does not mean they cannot both give consent. However, the ruling should be judged in light of its circumstances and other existing laws. If these other laws are found to be harmful or obsolete, they should be abandoned, but there is a reason that incest is illegal. Even though there is nothing inherently bad about it, there is a greater chance for its offspring to be deformed in some way; therefore, I am against it when it is not practiced safely. Furthermore, one who engages in incest should be prepared to have an abortion if the preliminary preventative measures fail. I do not see how anyone can justify bringing a life into the world that will suffer and/or drain substantially more resources than others.

Wow, this is really a bad idea. Not only is there a higher chance of deformities and disabilities in the child, but think of what would happen if people within and outside the family found out.

And this doesn't just apply to brothers and sisters, it could apply to the parents aswell! It could really screw with kids heads if their sick-minded parents started tapping them. Ugh!

You guys do realize that the majority of incest occurs between cousins and not the nuclear family, right? Even with the Fraudian complexes being true, our minds are built to fight incest and rebel against parents and siblings as an adolescent. Furthermore, while genetic defects are raised in incidents where incest produces children, the defects on the first generation of incest are grossly exaggerated. We have all the animal breeding to prove that, especially when the incest isn't in the nuclear family, the genetic defects are more often in temperament and certain genetic diseases are given a higher chance of being present. Serious genetic defects like deformation and severe retardation are only made common in incest if it is encouraged past the first incestuous parents, which it typically isn't. It takes a few generations of serious inbreeding (sibling parents producing in each generation) to create those issues. Even if our government says it's ok, our society and our nature will say it is not. Because of this, I really don't see this as that big of a threat.
