Kakashi and orochimaru have some kinda history as orchimaru said something in the chunin exam when he came after sasuke. (something like ya didnt have that eye back then) blagh blagh blagh
Even though Kakashi *hit imself when orochimaru walked towards him if they where to fight for real then and now who wud win ? Kakashi with sharingan and over 1000 jutsu or Kakashi with Mangekyo Sharingan and more that 1000 jutsu.

I'd say Kakashi after the Shippuudens. He comes back stronger, more than anything else. His new sharingan techniques are damn good. Before, Orichimaru was stronger ... now, I'd say Kakashi

hmmm, judging from the capabilities I think kakashi has an advantage with obtaining a new kind of sharingan and all but like hatake_kakashi29 said orochimaru is not human he is a freaking snake! and I don't think kakashi could predict what goes in that snake bastard's twisted mind so in the end I have to say they're pretty even...
