Oh I think know this one, okay the reason why some episodes are copyrighted and some aren't is because *I believe* distributors are only allowed to copyright so many episodes at a time. Since shows like Bleach and Naruto are so long, the distributors, I think (not 100% positive) can't copyright them all at once.
Also it is more difficult to copyright something in other countries if it hasn't even come out compeletly in Japan, hence why Naruto Shippuden and D. Gray Man hasn't been taken off yet. Distributors will wait until the anime is complete and then copyright the entire anime instead of copyrighting a few episodes at a time. Therefore it is easier to upload shows that are still continuing in Japan (Bleach, Naruto Shippuden). With shows like Emma, Zero no Tsukaima, and Saiunkoku Monogatari, Distributors waited till the series was done airing and as soon as it was done in Japan, it was almost licensed immediatenly. So I think US distributors will only licensed things that have aired completely in Japan. Just watch, as soon as D. Gray Man is done airing anime in Japan, it will become licensed.
Also, shows that are licensed need to have some timeframe of when they will be out in the US. If the distributors don't have an arrangement for dubbing and a round about release date then the process is backed up, hence why old shows like Rose of Versailles and Seto no Heyome are not licensed. No one has made any arrangements for it to be dubbed or released. That's another reason it isn't licensed yet and can be uploaded
Lastly Distributors do not license shows that don't have much of an audience, they review the critics and popularity in Japan before licensing it themselves. Also because of merchandising Distributors will crack down on uploading popular anime like Haruhi and School Rumble to minimize the number of sales lost to the internet. That's why people probably find it harder to find those shows then others
So no it isn't biased, licensing and therefore uploading shows is merely decided by the anime's length, airing date and popularity. Well there is luck, but crunchyroll is good at stopping shows that become licensed (whether we like it or not). And small websites can get away with uploading for a little longer, but with shows like Deathnote they are eventually found out. However I do know that it is difficult for distributors to crack down on some websites like limewire or Veoh because the website is essientally just sharing with other people. It is like a friend borrowing a CD. Also, If subbers like Dattebayo put out episodes that they created and subbed themselves, I believe it is more difficult for distributors to corner them.

I don't know if this is entirely accurate, this is all information I pieced together after talking to some people who deal with this stuff. So I hope it helps but don't take my word as the final word. Thanks
