People are getting the issues crossed here. She didn't lose her right to be a mother, she lost her right to be a mother with the fertilized eggs in storage. The fact that it was her last chance (to be a mother to her own biological children) is painful, but not the real argument. So, personally, I would say it's a fair verdict. The law has no need to take morality into account, so I'm glad they didn't in this case.

Was it a morally good choice though? I would tend to fall on the negative side here. The right thing to do would have been to get a waiver of parental rights signed, then let her have them. Of course, we're not the man here, so our logic is likely vastly different from his, partially being as we're only getting one side of the full story here.

EDIT: With all this said, I'm also a fan of the idea of a 'paper abortion'. Since in many places, a woman may get an abortion without any consultation of the male, I believe men should have the same right. The difference is, a 'paper abortion' is just that, paper only, it's not forcing the woman to have an abortion. It just means the male has no claims on the child and will never have to pay child support.

There's a host of stipulations about it though, so don't think it's an easy-out for the male.



Agree 100% with the above statement. While I understand many people in here will sympathize with the woman's plight, you all need to understand that in this case both the male and female have equal share to the fertilized egg. It sucks for the woman because as many of you have mentioned, it's the last time she will be able to have children, however in the eyes of the court this doesn't and should not matter one bit.

The fact is, it is NOT her body. This is a fertilized egg stuck in a test tube meaning that the man's sperm is already injected. So it is 50/50 giving both parties equal say on the matter.

what a heartless guy...... i mean, i can understand that he divorced her because he didn't get much sex...and men can't really live without sex. BUT he could at least give her a child. the poor woman lost almost everything, including her rights. it's the LEAST he could do, out of kindness. but DAMN him......

This then will bring up the question of- If a guy gets a girl pregnant would he have the legal right to force her to have an abortion because technically half of the product is his >.>

That was just bullshit. I have no idea how such a selfish deceiving bastard won that case. Especially when it violated that lady's rights >.<

At the very least the apparent brainless judge (or jury) could could have decided to rule that the lady could have her baby but that father wasn't liable for child payments.

you bring up a good point....i mean its true your sperm is in that egg...but then again how many guys dont leave their pregnant girlfriends or wives...i mean if he wants to be the responsible adult he should you know provide for his kids.....

but you know some guys wont....so he should've just let her be happy and have her kids.....and i doubt after he cheated on her she eould want himto be with her kids

Well, the child is partially a product of him, so he should definitely have a say in it, though his reasons are jackassish. There's not always an answer that will please both sides and there're not always possibilities that are so black and white, but that's just how it is.
