...Harsh! Well, community service does sound like a good idea. I think they should make the kid see a shrink... Maybe take self controll classes or something...

i agree that the kid who killed the bully shouldn't be punished...i mean c'mon its self-defense and im sure he is suffering mental anguish enough already. he probably needs a psychologist to sort him out and not become a delinquent or turn into a killer.....trauma that bad shouldn't be added on with accusations...and as pointed out earlier he's only 11....he probably didn't understand the consequences of using a bat as a killing device apart from making the bully think twice of attacking him....i just feel that the boy is to be pitied coz he's got the burden of killing sum1 on his conscience for the rest of his life.

So basically your all saying killing someone is A-ok? As long as your smaller then the other person its allright to grab any sort of weapon and proceed to stab/shoot/hit the person? The courts are already to lenient on young offenders.

The whole self defense thing it doesn't fly with me. In the United States, the defense of self-defense allows a person attacked to use reasonable force in their own defense and the defense of others. REASONABLE force not DEADLY force there is a huge difference.

Kid should've ran like hell. Just another example that fighting is a thing better left undone. Perhaps some good will come of this. =/

The problem here is that not many people do much for people who are victims of bullies. What he did was wrong but I can see why it would happen.

At the same time, it's going to be quite nice not having that bully, fuck around with the minds of others.......
If it means sacrificing the innocence of one person to make sure that others are ensured safety from another then I would gladly make and enforce that.........

Somehow I have this odd inclination to believe that if -you- were that innocent person you would have an entirely different view on this subject! It's easy to say "Sacrifice is necessary hen you are not making the sacrifices!

Only Canadians say such stupid things, really now..........
My aunt is a Canadian citizens and she could crush anyone here with intellect. Her IQ not only rivals but dwarfs Bill Gates'. Correct me if I’m wrong but that seemed to me to be a very spiteful and ignorant thing to say. Please refrain from making a racial battle out of this thread. Prejudice is absolute umbrage for me!

Well, I was given the same raising. But, I still run. Anyway, if you were taught to go around and murder every virgin girl you see would that make it right? Not to say your wrong, but I must ask what the point in taking a beating in this situation would have been? To make a point? Well... What point would that have made? The bully would've just gone on with the macho feeling that he is rugged because he could kick the snot out of somebody smaller than him. Of course he would get the same sensation from having the kid run, but at the same time the kid would escape a beating...

I run from fights all the time. I believe that, unless you are protecting someone or something, fights are stupid ego clashes. I blame men who aim to injure for insult for the bad name that men have gained around her.

Running is, almost always, the best choice. That's my opinion of course.

Recomended reading on topic: The Wounded Spirit, Frank Peretti.

This man, (Frank) and I agree with Kankokujin. People say being bullied is part of growing up. Once upon a time, sure, but now things are not quite the same. Being bullied by a kid your age who is slightly bigger is one thing. Being attacked by somebody who is 13 when you just hit puberty is another! As for me, I'm bullied all the time. Usually by large groups of kids. (By the way, would you stand and fight in such a situation Noodle?) Nobody does anything. These jocks make the school a football team, so they can do whatever they want!

The kids in jail for what seems to be pure self-defense...Bullies of the World 1, Justice 0.

Seems that trial for a scapegoat instead of a murderer.

I think in this case, its more of he was just trying to stop the guy from hitting him and accidentally killed him in doing so.
Its all an accident. He didn't start the fight, he was pick on.

Its like you're driving a car and suddenly some dumb ass just dash out. Next thing you know he's dead.
then do you think it should be charge under murder?

Actually, (and I know this cuz it was on my driver’s test) In this situation you are legally guilty of vehicular manslaughter. If at any time a motorist hit’s a pedestrian the motorist is -always- at fault. Stupid, eh? Well, I see what your saying. I agree. This is not the same as killing somebody on purpose.

Edit: Of course this law varies from place to place. I just know that's the law in America... At least in the states I've visited.

I think he got what he deserves, it may sound cold but I couldn't give a rats ass you don't use weapons in a one on one fight no matter how bigger and stronger the other person is.

Gatz, are you much of a fighter? It's easy to say something like that when you know what you're doing... When you can defend yourself! But this was just a scared child who reacted to an assault from a larger boy in a bad way.

But, then again, that is true. It is a cowardly thing to do to use a weapon. However, he's going to prison for this! He'll be a grown man before he's out! Is that punishment really fair? Years of prison, a ruined life, and all for being a coward?
