He fought Ichigo but loss and seemed to eventually be OK with losing and almost seemed to be friendly with Ichigo. Noitira landed what should have been a fatal blow. If Bleach was a show where people died, He'd be dead. But because he almost seemed to turn good at the end, there could be some excuse for him to still be alive. I think its cooler if he died though. Bleach cops out and brings people back from the dead too much imo.
