Well then, we have talked about various things, but as the main topic of this series, let's look back at the journey of Tohoshinki from the Arena Tour to Tokyo Dome last year, at the transformation from Kobe to Saitama Arena. Just a few days ago at Kobe, he was still sitting on the wheelchair the whole time, so we couldn't believe what we were seeing...

Junsu was standing in the same line with the other 4 members, and they greeted us in harmonization like they always did!

That, just that... Saitama Super Arena burst out with cheering!!! I was so touched that I lost my words. He held such a strong will that made him recover surprising fast.

Whenever they performed dance songs, Junsu either sat on the chair or stood by himself singing on the main stage. Other than that, whether it was on the main stage or sub stage, the members were always singing together. It was such a spectacular sight that made me feel so happy.

Then, we got so touched to see Junsu walking from the main stage to the audience! Seeing him walking, everyone cheered for him passionately.

When they first walked to the main stage and headed for the sub stage, two members would walk first, following by the other three. Since his injury was not fully healed, Junsu had to take it step by step. Therefore, the other members also slowed down so that they could walk together with him, and everyone was moved by that scene.

Moreover, this time, the other members were totally different from last time.

In Kobe, because they knew what Junsu was feeling, they were also standing on stage with restless emotion. However, this time, even if Junsu was only able to stand or walk together a little bit, the other members looked so much different from before. Because of Junsu's injury, last time, his part "Sexy Lady, A~n" in "Choosey lover" was done by Changmin. However, since he had somewhat recovered this time, the other members had the "What should we do this time?" look on their faces, but Junsu made a "You do it today too" face to Changmin, so in the end Changmin was the one who did it.

Then for "Summer Dream", when it came to Junsu-sensei's dance session, everyone was having the "What should we do?" look on their faces again. Jaejoong suddenly came up from nowhere and said "Today Jaejoong will do it!". However, although he was supposed to come up with three dances, he was only able to come up with two. Good job anyway (LOL)

This time, we didn't really feel that Junsu was away from everyone anymore. Moreover, Junsu looked like he wanted to dance, thus from the beginning to the very end, I felt like he was really trying to dance. Jaejoong also said, "When we were rehearsing, Junsu would say that 'I'm fine now [so let me dance]' all the time". He just wanted to dance that much, didn't he?

I think that the members would not be able to raise their tension without these kinds of comments from Junsu.

For the first time, I saw every seat in Saitama Super Arena filled with audience, and that was just admirably amazing. And like always, the red ocean was always the best!

With Junsu's quick recovery, everything started to change and the stage looked more complete. Little by little, the tour had become much more delightful. Successful performance after performance, we were able to feel that something would come up, and the remaining story of their road to Tokyo Dome will be continued next time.

TVXQ to Resume Careers in Japan

Korean boy-band TVXQ will visit Japan in autumn in an attempt to resume their music careers
after being mired by a legal battle with their management agency.

Japan’s Daily Sports reported on Oct. 29 that TVXQ will come to Japan
to participate in year-end TV programs.

The sports newspaper did not mention the Korean idol group’s schedules in Japan,
but said the group is expected to appear on major entertainment TV programs such as
Japan’s TBS record awards and NHK’s song competition.

TVXQ’s move came at a time when three of the five-member group is in a legal battle with
their agency, SM Entertainment, over the validity of their contract.
The three — Hero, Micky and Xiah — claim that the contract is unfair.

On Tuesday, the Seoul Central District Court said parts of the contract should be invalidated.
The court also paved the way for the three to stay in the five-member group
and continue with their solo activities (as well).


Rumors had it that the boy band may be disbanded as the three are expected to leave
SM Entertainment. The agency revealed its intention to appeal the case.

But news reports said that despite the legal battle, the group will unlikely be disbanded.

Fans are expressing stiff objection to a possible dispersal of the group.

[NEWS] “HTTG” to be Early Cut After 16th Espisode

MBC drama “Heading To The Ground” will call its early ending after the 16th episode airing this November 4th. The drama was previously planned to have 20 episodes, however due to the poor rating record, finally its episodes are cut and will finally have an early ending.


“Heading To The Ground” crew on the 29th after the broadcast of the 15th episode said, “The final episode will be aired next Wednesday,” announced such caption informing the viewers.

The drama ending episode is too early even than the previously expected, caused many dissapointment from the viewers.

Earlier before, on last November 14th, “Heading To The Ground” crew confirmed, “The final is planned to happen after 18th episode.” Therefore, “Heading To The Ground”’s successor “Heroes” would kick off its first broadcast on November 11th, a week earlier that it’s previously scheduled.

Much attention has been put on SM Entertainment and its future actions as the Courts have sided with the three TVXQ members YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu on the legal dispute between the three and their agency regarding their exclusive contract.

On the 27th, the Seoul District Courts partially accepted the exclusive contract suspension request against SM Entertainment submitted by Xiah Junsu, YoungWoong Jaejoong and Micky Yoochun.

To have the Courts partially accept the exclusive contract suspension request is to have the Courts decided that the contract between SM and the members of TVXQ is in fact unlawful. According to the decision of the Courts, SM is not allowed to interfere or question any individual activities of the three members or create contracts regarding group activities without the consent of the three members.

For now, SM has stated that the agency cannot accept the Courts' ruling. If TVXQ's birth is inspected, the process is a system with no room for 'communication and respect.' TVXQ is a team that was created by picking the best out of hundreds of trainees and forming a group. Even the members themselves would not have known what lay ahead of them in the future of their music careers. They were able to snag the title of 'Top of the Korean Music Industry' under the system of a large entertainment agency, and their entrance into the overseas market was probably calculated meticulously. The entire process would amount to a total of 10 years.

As this much time has passed, the members are bound to have looked back on themselves. They are also bound to have increased their musical control and bettered their abilities to select their paths. There were times when they had to stand on a stage regardless of the fact that they did not want to, and they would have had to handle the agency's actions to stop any activities that may 'endanger the group' with a feeling of oppression. This is where 'communication and respect' is needed. As the two sides are the bests of the best, there probably was the need to approach the situation calmly and after much thought. If things have come so far, there were bound to have been instances unknown to the public that pushed it so far. To become irreparable.

In truth, the members are preparing to 'sue for the nullification of the contract and compensation for damages incurred from the income division' while SM is submitting an appeal. SM has also stated that they will be revealing information that has not been told before and releasing an official statement.

[INFO] Summary and Interpretation of TVXQ's Exclusive Contract Agreement

The Court has granted the injunction filed by the members of TVXQ against SM Entertainment.The Court found that the Contract between SM and the Members was unconscionable and against public policy. Following this victory, the Members are proceeding with the main suit to ask for the rightful shares of all income generated from their activities.

The following is a summary of the outrageous terms of the Contract that relates to the distribution of income. The clear conclusion is that the TVXQ members have received next to nothing for their six years of work, and that virtually all money we spend to buy SM products stay with SM. Please read the below to see the extent of the injustice.

Please keep in mind that SM’s contract with TVXQ has been amended five times and therefore the applicable terms have varied over time. Accounting for all the resulting complexities, the truth adds up to the following:

I. TVXQ has received $0 for their album sales prior to July 2008, and only a negligible amount after that date.

Prior to the fifth and final round of amendments on July 1, 2008, the Contract read that for any album or single with sales not exceeding 500,000 copies, SM would be entitled to 100% of the profits, leaving the members with nothing. From the time of TVXQ’s debut in late 2003 and until TVXQ’s release of their 4th Korean album “Mirotic” in September 2008, no Korean album had sold more than 500,000 copies. Therefore, prior to July 2008 TVXQ has had absolutely zero income from their album sales.

On July 1,2008, SM amended the Contract to give each Member 1% of total sales for each album that sells over 200,000 copies. For any albums that sell fewer copies, the members are to receive 0.6% to 0%. SM has not honored even these outrageous terms, as it has not paid TVXQ a single cent since February 2009.

In sum, SM has kept 100% of all sales that TVXQ has generated with the sales of their albums and singles prior to July 2008, and has kept 95% or more of the sales after that date.

II. TVXQ has received $0 for the sales of concert DVDs and albums featuring recordings from such concerts.

Under the Contract, the Members are not entitled to receive any share of the profits generated from sales of concert DVDs and “live” albums.

III. TVXQ has received $0 for their appearances on TV programs.

Under the Contract, Members are not entitled to receive any share of the profits made through their TV appearances if the appearance is of a temporary nature. As all programs on which TVXQ appeared have featured the Members as “guests”and therefore by nature have been temporary, SM has kept all profits that TVXQ has generated from these TV appearances.

IV. For all other possible sources of revenue, SM subtracts from the total revenue all expenses, including salaries of other staff, stage preparation expenses, rent, travel expenses, food expenses, and the like, then gives TVXQ only a fraction of the remaining amount.

As for all other sources of income, the Contract states that TVXQ is entitled to varying percentages of the “net income.” The Contract defines “net income” to be the amount remaining after the applicable “operating costs”. The “operating costs” are defined to include such expenses that are traditionally expected to be covered by the employer, including but not limited to 1) salaries of the staff (manager, clothing coordinators, makeup artists, dance crew, and the like), 2) performing stage preparation costs, 3) living expenses, including rent and water/electricity bills, 4) travel expenses, including plane ticket costs, 5) meal expenses, and the like.

Even after all these “operating costs” are deducted from the net income, the Members are only entitled to a small percentage of the remainder while SM keeps the rest.

Following thevictory of the granting of the preliminary injunction, the Members now prepare for a suit to claim their rightful share of the profits that they themselves generated. At the end of July, when YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu filed the dispute to the Seoul District Courts, Cassiopeia rose up as strong 'supporters' by criticizing and highlighting every single unlawful clause in the exclusive contract that gave the agency the upper hand.

The support given by the fans of TVXQ are somewhat different from the actions of those of previous idol groups. First, instead of engaging in emotional, group activities against the agency, they are acting in a efficient, sensible way by informing society of the unlawfulness of the contract.

On August 14th, at the Korean Cultural University's debate 'Problems and Solutions to the entertainment management system through the TVXQ situation', Kim Euna stated, "If you look at the schedule of TVXQ that the fans put together, the amount of work that TVXQ has been put through ever since they debuted is an incomprehensible amount," and "Please don't see this dispute as a mere fight for money, but a fight to protect human rights."

Fans also walked to the streets. The petition that began online and offline on August 26th gathered signatures from 188,000 people who were against the unlawful contract system that was rampant in the nation.

Fans submitted a petition to the Seoul District Courts who was in charge of the case to act as witnesses for the unlawful act put upon minors by the agency under the name 'People who are against SM's unlawful contract.' In this petition, they stated, "Please put an end to contracts that chain celebrities and puts them at a unfavorable, unequal position."

Their voices have risen towards national organizations as well.

They submitted another petition to the National Human Rights Commission saying, "In the case of celebrity exclusive contracts, they are not contracts for the trade or sale of objects, but for human talents and work which means that the basic human rights must be protected before anything else. Therefore, the National Human Rights Commission must lend a helping hand in this issue of the unlawful contract so that it does not violate the human rights of the members."

They also visited the Fair Trade Committee and filed a complaint against SM Entertainment's unlawful trade using the exclusive contract saying, "SM Entertainment abused its power and involved TVXQ in an unlawful trade."

They also filed for a Compensation request against SM to the Korea Consumer Agency when the agency indefinitely postponed the 'SM TOWN LIVE 09' concert in August. The fans stated, "This is not a problem between fans and an agency, but a problem between consumers and sellers," and said, "We are not merely asking for compensation because we want our money back, we are filing this because we cannot sit back and let a company tyrannically attempt to take control over us and we wish to get back our rights as consumers."

Recently, the fans criticized the Korean Youth Committee's action of giving CEO Kim Young Min an 'Order of Merit for Teenagers' for "Supporting the growth of the teenager culture" by saying, "By giving Kim Young Min this order of merit during the waiting period for the verdict, the Korean Youth Committee is giving up its neutral position in the trial and taking sides on the issue."

The movement of fans did not stop at the Korean border. Fans from 40 countries around the world collaborated on YouTube by writing messages of support to TVXQ; all connected by the love for the group. Japanese fan club 'Bigeast' showed their unwavering love for TVXQ by collecting 1000 messages of support.

As the fans' voices rise, politics began to move as well. The TVXQ dispute has become a 'hot potato' at the National Assembly.

At the National Assembly's inspection of the Department of Culture, Sports and Tourism, many officials said, "Many entertainment agencies are putting unlawful pressure and orders against their celebrities and have gotten to the point where they violate human rights," and put forth TVXQ's 'slave contract' as the main example.

At the National Assembly's inspection of the Fair Trade Committee, official An Young Ho talked of the problem of Exclusive Contract Lengths which came up due to TVXQ's exclusive contract suspension request and stated, "We are seriously investigating the problem of TVXQ's unlawful contract as a complaint has been made," and "There is a problem with the length of 13 years."

Whenever fans got involved, they stated, "If we leave things as they are, the 'bad root' of the entertainment business will continue to grow," and "We must correct this activity as soon as possible to ensure that another TVXQ does not come about."

YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu thanked these fans right after the Courts' decision was revealed.

Through their legal representative, they stated, "We would like to sincerely thank the fans for their unwavering trust and support," and "We will repay the Courts' decision to free us from the unlawful exclusive contract and allow us to pursue individual activities by striving to become unique true artistes."

TVXQ fans are still holding a boycott against SM Entertainment. They are still striving to receive their compensation from the Korea Consumer Agency. Although the Courts have made their decision, it seems as though the fans will not stop their actions against the agency. In fact, these actions may not cease until the lawsuits of the exclusive contract and income division end. They don't seem to be slowing down anytime soon.
