What bill are we talking about?

It's S. 3804, the Combating Online Infringement and Counterfeits Act (COICA), introduced by Sen. Patrick Leahy (D-VT) and Sen. Orrin Hatch (R-UT). It's currently being considered by the Senate Judiciary Committee.

What exactly does it do?

The bill creates two blacklists of Internet domain names. The first can be added to by a court, the second by the Attorney General. Internet service providers (everyone from Comcast to PayPal to Google AdSense) would be required to block any domains on the first list. They would also receive immunity (and presumably the government's gratitude) for blocking domains on the second list.

What kind of domains can go on the list?

The list is for domains "dedicated to infringing activity," which is defined very broadly — any site where counterfeit goods or copyrighted material are "central to the activity of the Internet site" would be blocked.

What's so bad about that?

Well, it means sites like YouTube could get censored in the US. Copyright holders like Viacom argue that copyrighted material is central to activity of YouTube. But under current US law, YouTube is perfectly legal as long as they take down copyrighted material when they're informed about it -- which is why Viacom lost their case in court. If this bill passes, Viacom doesn't even need to prove YouTube is doing anything illegal -- as long as they can persuade a court that enough other people are using it for copyright infringement, that's enough to get the whole site censored.

And even without a court order, sites can get blacklisted just by order of the Attorney General -- and the bill encourages ISPs to block those sites as well. ISPs have plenty of reason to obey a government blacklist even when they're not legally required.

whats up with the world, first they want to censer video games now this!? why not just abolish the whole 1st amendment...---...

im all for protecting copyright stuff but not at the cost of having someone censer where i can and cant go on the internet

yeah. I'm also with some politicians on supporting and protecting the copyright of the authors, heck I'm here in CR and paying the premium service to support the anime industry but this censorship is just way too much.
Besides, isn't the fansub community "kinda" helping the anime industry indirectly (advertising or taking a first look at the anime)?

Anyway, this bill of internet censorship will not only affect the Anime/manga community but the whole freaking internet community will be affected one way or another.

I for one though don't think this bill will be passed but if so then this "internet" is just f*cked up or at least here in the US

Fortunately, this will only affect ISP's and internet-related things in the USA. Unfortunately, this means that if one would like to access banned/censored sites in the USA, one would need to circumvent said sites by accessing them via another ISP in another country. I think that is how it would work. I do not have the technical know-how in this area.

We shouldn't fear the main sites, like YouTube, going down. It probably will just be a cleaning out of the sites. There will be less material, and there will probably still be licensed shows on the site (legally with permission from main companies), and there will still be independent user submitted content. Since I do not represent YouTube, your guess is as good as mine what happens to the site.

I would not be surprised to see sites like Myspace and Facebook be affected either.

I think the point is to stop piracy in the early stages, even if is to curb exposure to new stuff, as in the case of fansubbing.

What it seems to boil down to though is the basic message of if one doesn't have the money, one cannot have access to content, whatever it may be, unless the permission is given for content.

I hope this does not affect the sites I frequent.

I hate this crap. It's annoying me extremely that certain things on Youtube are blocked. Getting my hopes up like that.
I'm for protecting it copyright material, but dang it blocking sites from me is too much. .__.

do you honestly think the petition will work, while Youtube has a lot of copyrighted material I doubt that it would be blacklisted. I do agree that those that hold the rights to certain material should be protected from infringement its not gonna happen as long as people just don't give a damn.

‘(2) DOMAINS FOR WHICH THE REGISTRY OR REGISTRAR IS NOT LOCATED DOMESTICALLY-

‘(A) ACTION BROUGHT IN DISTRICT OF COLUMBIA- If the provisions of paragraph (1) do not apply to a particular domain name, the in rem action may be brought in the District of Columbia to prevent the importation into the United States of goods and services offered by an Internet site dedicated to infringing activities if--

‘(i) the domain name is used to access such Internet site in the United States; and

‘(ii) the Internet site--

‘(I) conducts business directed to residents of the United States; and

‘(II) harms intellectual property rights holders that are residents of the United States."
