In Washington state they don't put the kids in jail when they miss a lot of school.. they put the parents in jail and give them a hefty fine! I don't know about Texas but here you can drop out of school at 16.. so why would you put a 17 year old in jail for missing class now and again.. if she's a honor student she must be doing fine even with all the school she's missed.. to me this incident is just absurd.. the school should never have called the police (don't they have actual criminals to arrest) and the judge was an idiot! Texas... WTF!!!

Cruel and unusual punishment - the judge needs to study law again. He even admitted he didn't know the full circumstances yet he jumps into action - look before you leap.

He proved himself to be a failure of a judge.

A night in jail and a 100$ fine is not Cruel and Unusual Punishment for breaking a law. True, he should have looked at her situation before issuing a verdict, but that does not warrent an accusation, especially one that's false.

I withdraw my statement on the Cruel and Unusual Punishment part. I actually though more about it and the "unusual" punishment part can be debunked. Isn't it the judge's job to look at all, if not most, of the [presented] facts before issuing a judgement? That's the part which bothered me the most.

Judge Lanny Moriarty warned Tran back in April not to miss any more school; when she missed again last week, he issued a summons and had her arrested in open court Wednesday. Tran was sentenced to a night in jail and ordered to pay a $100 fine.

I need more research on Texas's position on truancy, but most states give the schools the power to decide whether they want to take action on the students under parental responsibility. Assuming Texas is one of those states, the girl should not had been targeted but her guardians.

I'll stop right here because I'm not even half awake up nor was I when I posted my earlier mostly irrational message.

I have seen a lot worse students miss a lot more school and not be punished.

“If you let one (truant student) run loose, what are you gonna’ do with the rest of ‘em? Let them go too?” Moriarty asked.

He admitted to KHOU after the fact that he didn‘t know the full circumstances of Tran’s situation. He said he might work to have the arrest removed from her record, where it would otherwise remain.

Hey idiot Judge that's the whole point of a trial but you are probably to ignorant to listen. The judge probably didn't give a crap about the kids reasons when he tried to plead his case. Judges are just politicians and unfortunately prone to human error and bias! That is why you need a good lawyer to cut the bureaucratic red tape. Oh wait a teen paying to support their family can't afford one and probably can't even afford the $100 fine.

Making an example out of people is wrong..

Just what is the world coming into? I no longer know what's the standard of being normal or not anymore. I wonder how the system will be in the coming future.

What people don't realize is that it's not the one day in jail that's really the bad part. I mean yes going to jail at all is really bad but, it's mainly the record you get with the jail sentence that can screw someone's life. I mean this young woman will now be labeled as a criminal on her record whenever she tries to get a job, go to college, or even if she wanted to join the service for some reason. This girl worked her @$$ off and is now being struck down because of 1) bad school system 2) bad judge and 3) bad laws. I love America but damn do I hate my government. It's not Obama fault either; it's the whole damn system that's screwed up and people either just don't care or are just too clueless to do anything about it.

That's just stupid. Seriously, I'm loosing faith in America's judicial system. I think I'll move to Canada or something.

Way to go!!!! Now the community won't trust the people who supposed to serve and protect.
It's chaos I tell you!! Kind of Ironic how the judge said He was not fully aware of the circumstances pfffft.

Not like we don't already know that judges from Texas are no different from the guy who led Jews through the desert.
