The same way many us do it. Getting to know the person and eventually you will figure out when the person is happy or sad.

Artificial Intelligence and Sentience are two different things. Artificial Intelligence is still programming, but programming that exercises judgement. That does not mean it's self-aware. Sentience on the other hand is not only self-aware, but self-determining. Sentience makes decisions for itself, and does what is best for itself.

When a machine is able to become sentient, then we'll have to think about how to deal with it when that time comes. Otherwise, AI is programming that sentience constructed and continues to manipulate.

They can't feel or be hurt.

Not unless they're program to be an sensitive little teacup, and definitely don't try giving them artificial intelligence- it's too weird.

The question is the AI self-aware if it is then yes if not no. Being self-aware is unique so far we are the only ones that we know of that are there is some talk about whales and dolphins but it hasn't been proven yet. But if an AI was self-aware you would want to grant it the same rights as a human mostly out of common respect yes it may have a robot form doesn't mean it has to stay that way. Bi-centennial Man does a good job of explaining this good movie.
