Whether it be anime or manga, should people who have/seen loli or shotacon be sanctioned as if they were possessing child pornography?

I'm still confused about where I stand on this topic. Some say it is constitutionally protected under the first amendment. Others say It perpetuates sexual abuse against children and encourages pedophiles. What do you think about these points? According to U.S. law, loli and shota might or might not be legal...there is no straight answer. Bullshit right? This means you might go to jail if you have seen Boku no Pico or a kuroshitsuji doujinshi...and you are probably legally defined as a pedophile :x

hmmm this is a bit touchy but I say it passes as not illegal because laws and cultural views are a bit different here compared to where the literature is written. Idk, I'm no fan of loli and really not a fan of shota but its not like I am against them, I just don't watch them

I Think the art is fine but when it`s used sexually like a ecchi or hentai then Yeah be gone I Guess it`s like having a show about a crazy killer murder with no motive but it gives a positive message of murdering people it can be bad like how In Oreimo the siblings like each other? It`s just my opinion I know it`s their art yadda yadda and they can do whatever they want with it but there is an extent when it can give off a horrible message.

Not real people, so no illegalization for me. If it was illegal, than everyone who's read "The Game of Thrones" books would already be in jail thanks to Danny and Drogo. Danny start at like age 12-13 in the books I think. Everyone is like period appropriate ages in the books.

No, for the simple reason that you cannot establish the age of a drawing. It is completely impossible to establish any kind of reasonable legal definition of drawn child pornography. I can draw a naked baby, claim it's eighteen years old, and nobody would be able to prove otherwise. Or I could just claim it's a random jumble of lines and color that may or may not happen to look like a naked baby, and nobody would be able to prove me wrong.

Similarly to what hcxangel said, If you can have an anime (or a game) about killing someone or doing some other extremely illegal action, than why can't you have an anime (or a game) with loli/shota?

If one influences people to do something in real life (which it never actually does), than why wouldn't the same apply to all?

lolicon is associated with the sexualisation of pubescent. In colloquial terms Lolicon is a form of paedophilia.
This is where the debating comes in Art has many forms for example film filming a movie about "Let`s say a Lolicon in real life" it`s going to get red flags due to it`s message "Pedophilia is alright" like the film American Beauty which has alot of controversy.

And everyone has their preferences for some reason I find it more fine killing random monsters in a game better then watching little girls having sex :l

Allow me to apply it to something that also has an age restriction (an even higher one at that), alcohol.

Just because sex is sex, it doesn't make it any worse (other than by your morals) than say, under aged drinking. Even more so if an adult was to give a child alcohol, than it would basically be the same thing.

P.S. Sorry, I went to edit something in this and kind of broke it? fixed it best I could, you get the idea.
