I'll partially agree. This girl should receive full punishment for her actions, BUT. The article mentions that she may have bee under the influence, didn't know the gun was loaded, and it seems that she is generally ignorant on how to properly use a gun in the first place. I wouldn't dismiss her as an evil murderer. This is just a conglomeration of her misguided choices, and the result is an unfortunate... Well, accident. I'm sure she had no intention to kill her brother.

Not that she should be let off the hook, but these kind of things need to be take into account.

stupid people = Do stupid things
If your going to mess with a gun at least check the safety, unload bullet clip, and check the chamber for a round...
Better yet don't mess with a gun it is not a toy, want to use it for fun they have proper facilities called shooting ranges!

As for guns needing to be outlawed...nothing will change unless our culture changes even if they were outlawed! There are places were no guns are and others where everyone has a gun. Those places can be like that because of their culture...our's is stupid among many other negative traits!

I agree with Aoki above ^

That's why there are different classifications for murder (1rst degree and 2nd degree) and there is also the manslaughter charge.

I wonder if she had accidentally hit him with a car if it would have even made the news?

Such stupid people... what makes people think it's safe to put a real gun, loaded or not to a persons head is beyond me. Get some common sense people! You know they are going to use their stupidity to push for the ban on guns the media swallows this kind of stuff.

I wouldn't say a winner. Sadly, there are many more things, many times more stupid than this.

Why isn't the story focusing on the person that took out the gun in the first place? That's the responsible party. That's the person that knew if the gun was loaded or not.

The responsibility falls on the person that took out the gun in the first place.

However sad it is that his life ended in such a way... my freaking goodness how stupid can you be? Why would you pose for a photo like that with a loaded gun? Someone as ignorant and idiotic as that shouldn't even be allowed a gun. He and his sister could just have easily 'accidentally' shot someone else.
The upside to this, mostly upsetting, news story is that at least their stupidity only harmed themselves.

Well my guess is the weapon wasn't even legal and these idiots obviously don't know proper firearm handling rule. 2 major ones
#1: Don't point a gun at anything you don't want dead. Regardless of it being loaded or unloaded.
#2: Don't put your finger on the trigger unless your ready to blow away whatever the muzzle is pointing at.

That's true, and the way the law reads you can't convict some one for being stupid.

I'm not sure I'll ever understand what makes people want to do stuff like this -- hell, I usually make sure to aim the scissors at the ground when I'm carrying them. If the urge to look gangsta is too deep for you, then use an airsoft pistol. Most people won't even notice the difference, and if they can notice the difference, then their knowledge of weaponry is probably advanced enough that they wouldn't be impressed by gangsta posers anyway.

Argh, I hate to hear news like this. Whenever negative news surrounding weapons jumps up there are always those who go nuts and start shouting 'ban them' from the rooftops. Is it not common sense to not point a real gun at your head even if you don't think it's loaded? As someone who has been educated in how to safely use a weapon it's always frustrating to hear things like this.

This. We can't blame guns for people's death the same way we can't blame a fork for being fat, it is but an instrument.
