Yo, my uncle has been battling the courts for a long time to get sole custody of his daughter. His ex-wife is struggling with drug addiction, has no income, and currently leaves their daughter with her grandmother, who is also very poor. Most of my uncle's child support money does not benefit the child.

Like every member of my immediate and extended family, my uncle is highly educated, has a high paying job, and is a very nice guy with no criminal record. We'd like to continue this trend and not let anyone fall through the cracks.

However, laws across most of the USA greatly favor women when it comes to child custody. I'm very biased in this case, so what does everyone else think? Is this an issue that deserves better gender equality?

Maybe because they automatically gain custody because she gave birth? but they'll only grant the father
custody if 1. the child prefers dad over mom , 2. if mom did something to the child , 3. if mom i having living problems etc

i really dont understand why its like that myself

Tough situation cause in the end child suffers the most in custody battles. I would strike a deal to pay alimony and support in exchange for more visitation rights or custody. Child custody rulings can change year to year btw so if he loses he can keep trying but costs a lot and again kid suffers the most.

Is sadly very true. Reminds me of my Ex-aunt. My uncle paid for her through Lawyer School, bought them a $750,000 house, and lived in luxury in Florida. Then he found out she was just a _____. He got a divorce, she got custody. Funny thing is, guess her last paycheck? $112. No 0's. Just $112. She is addicted to alcohol and is verbally abusive.

I may not like that Uncle much, but I would rather the two kids be with him then her.

A child as a right to a safe and stable home. They shouldn't suffer if they don't have to.

I do wholeheartedly believe it should be easier for a child to be in a safe and stable environment in custody battles, especially over gender.

In your case, it's disgustingly wrong how damn difficult it can be.

Sorry, you are mistaken. Minors do have rights and there are laws specifying this. The problem is that they aren't exercised enough, which is why there are cases like* this (and worst) that occur.

I also live in the state of Georgia and the state does favor women over men when it comes to child custody, but it should be base on which parent has proof to take care of that child and have rights to that custody. My mom told her friend that he should go buy stuff needed for his boys (he has one than one child with more than one woman lol) and save the receipts to show that he really is helping in the matter when the parents were separated (they weren't married), but they have a child together. lol He didn't do what he suppose to and child support burn his ass. The uncle has to do everything in his power to win because the state, welfare, ect can be very biased.

In a custody case then your talking about bringing in a third party? For the childs rights your going to watch the child as they talk trash about both parents no thanks

It doesn't have to be a third party if there is a suitable parent available. The are tragic cases that happen when a child's safety and interest and aren't considered. Why do you consciously choose to give custody to a bad parent (drug addict mother)?

He should move closer. Perhaps the child should be where she is. Perhaps he should try and get along with both the mother and grandmother. Perhaps she was okay before the "currently" situation. I'm guessing by struggling with drug addiction, this might be someone who's trying to stop. A number of things can get in the way and constantly battling the father is probably not helping. It simply does not make sense to me that he's taken her to court so many times and lost, there's something missing.

The court almost always sides with mother even if she is addict then they say go to rehab but still get full custody 9 times out of 10 if its a full custody battle. Joint custody is much easier mutual understanding but that's because both parties are being civil
