I think the strangest thing I have heard lately is that the 2% of rapes are false rapes isn't based on any data whatsoever. But it has been taken as a holy number for 40 years.

Personally I'd say if a person is intoxicated and not capable of making a decision then technically that person got raped.

One problem searching the internet is it appears that even "experts" have no real statistics. I'd agree that taking in to account all reports that 5-10% false reporting seams to be the consensus. Still means that raping is earning an A or at least a B+ still not a good situation.

I stand by my recommendation of if you don't know ask, or if your concerned don't do it. Try not to get yourself into a he said she said thing in court. It never goes well.

You know what they told us in Basic Military Training? (ie bootcamp)

They said if you think the other person might regret the night, be the first of the two of you to report you got raped. Seriously. And it goes both ways, though the jury might be less sympathetic to a man reporting he got raped.

That's so messed up; we were basically told that it's a rape race. To avoid getting reported as the rapist, you should report the other person first.

You know at one point i would argue with you cause this is some seriously messed up shit and your contributing to rape culture but im just done. Im out.

Not a very good tactic even if tried.

A study in the UK found that only 37% of reports result in prosecutions, and only 18% resulted in conviction. A success rate of less then half, for what I dare say probably has more going for it then "she said, he said" though this was the UK so legal hurdles may vary. Open to sexual assault in general and the same report found that only 14-18% result in prosecutions.

And of course these matters are considered to be unreported which is by nature difficult to get at but has some reasonable grounds, its a highly traumatic event, going through all the motions of making the report is something of an ordeal, oh yeah and there's some grounds to say that indeed no one will believe you aren't just a dirty slut.

Though maybe that makes frivolous claims overrepresented in the actual reports since it avoids that.

Anyways took like 10 seconds to google-fu this up.

Yes many cases are turned away by either too little evidence or story to it, or just way too little to go on.
