I'd be pissed if I didn't know he was taking the pic. You could still threaten a lawsuit otherwise b/c you didn't give permission to release the pic...I think it's possible if you can trace it to him. Or you could just threaten him with a lawsuit if he doesn't get it taken down.

i'm hoping nothing like that will ever happen to me, and i don't see how it could but..
i would most likely break down, report to the police, not trying to be funny but see if i can make money by suing the person (mostly because me and the family are in bad money troubles >.<) and warn girls how it could happen ^^
